These Terms of Use ("Terms") govern your access to and use of the website located at unitedhw.com (the "Site") and any related services, tools, communications, portals, or features provided by United Home Warranty ("United Home Warranty," "UHW," "we," "us," or "our") (collectively, the "Services").

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Services. By using the Services, you represent that you meet this requirement and have authority to enter into these Terms.

2. Changes to These Terms

We may update these Terms at any time. If we do, we will revise the "Last Updated" date above. Your continued use of the Services after changes become effective means you accept the updated Terms.

3. Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, and share information. Please review it carefully. (Link it on your website footer.)

4. Service Information and No Guarantee of Coverage

Information on the Site may describe home warranty plans, pricing, coverage options, or service processes. Actual coverage, exclusions, limitations, fees, and obligations are governed by the applicable home warranty plan agreement or service contract provided at time of purchase or enrollment (your "Plan Agreement").

If there is any conflict between these Terms and your Plan Agreement, the Plan Agreement controls for coverage and claim-related matters.

5. Accounts, Registration, and Security

Some features may require you to create an account. You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Notify us immediately of any unauthorized access or suspected security breach.

We may suspend or terminate accounts that violate these Terms or that we suspect are fraudulent or used improperly.

6. Payments, Billing, and Renewals (If Applicable)

If you purchase a plan or service through the Site, you authorize us (and our payment processors) to charge your payment method for amounts due, including recurring charges if your plan renews automatically.

  • Pricing: Prices and fees may change as permitted by your Plan Agreement or applicable law.
  • Taxes & Fees: You are responsible for applicable taxes and non-covered fees unless otherwise stated.
  • Failed Payments: If a payment fails, we may retry charges and/or suspend coverage or access as permitted by your Plan Agreement.

8. Acceptable Use

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose
  • Attempt to gain unauthorized access to the Site, accounts, or systems
  • Interfere with Site operation, security, or other users
  • Use scraping, bots, spiders, automated tools, or data-mining methods without written permission
  • Upload malicious code (viruses, malware, etc.)
  • Misrepresent your identity or submit false information
  • Use the Site to harass, abuse, or threaten anyone

9. Intellectual Property

The Site and its content (including text, graphics, logos, designs, and software) are owned by or licensed to United Home Warranty and protected by intellectual property laws. You may view and use the Site for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or create derivative works from the Site content without our prior written consent.

United Home Warranty, UHW, and related marks are our trademarks. You may not use them without permission.

10. User Content (If You Allow Reviews, Comments, Uploads)

If you submit content through the Site (e.g., reviews, messages, photos, documents) ("User Content"), you represent you have the right to submit it and it does not violate law or third-party rights.

You grant us a worldwide, royalty-free license to use, reproduce, display, and distribute User Content for operating and improving the Services, and for marketing where permitted by law.

We may remove User Content at any time.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be uninterrupted, secure, error-free, or free of harmful components.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNITED HOME WARRANTY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF:

  • (A) $100, OR
  • (B) THE AMOUNT YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT.
  • Some jurisdictions do not allow certain limits, so these limits may not fully apply to you.

14. Indemnification

You agree to indemnify and hold harmless United Home Warranty and its officers, directors, employees, contractors, agents, and affiliates from any claims, damages, liabilities, losses, and expenses (including attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

15. Dispute Resolution and Arbitration (Optional but common)

This section affects your legal rights.

  • 15.2 Binding Arbitration - Except for small claims matters and requests for injunctive relief, any dispute arising out of or related to these Terms or the Site will be resolved by binding arbitration rather than in court. Arbitration will be conducted on an individual basis. The arbitrator may award the same relief a court could.
  • 15.3 Class Action Waiver - YOU AND UNITED HOME WARRANTY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
  • 15.4 Venue / Rules / Administrator - Arbitration will be administered by JAMS or AAA under its consumer rules (choose one). The arbitration may occur by video, phone, written submissions, or in-person in [Your State/County], unless the parties agree otherwise. If you don't want arbitration, tell me - I'll rewrite this section as court-only with venue selection instead.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where federal law applies (including the Federal Arbitration Act for arbitration provisions).

17. Termination

We may suspend or terminate your access to the Site or Services at any time for violations of these Terms, suspected fraud, security issues, or as otherwise permitted by law. Provisions that should survive termination (e.g., IP, disclaimers, limitation of liability, arbitration) will survive.

18. Miscellaneous

  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No Waiver: Failure to enforce a provision is not a waiver.
  • Assignment: We may assign these Terms as part of a merger, acquisition, or asset transfer.
  • Entire Agreement: These Terms (plus your Plan Agreement, if any) constitute the entire agreement regarding use of the Site.
